NEW YORK STATE CONSERVATIVE PARTY LEADERS FILE COMPLAINT IN STATE SUPREME COURT TO PROTECT CONSTITUTIONAL VOTING RIGHTS OF ALL NEW YORKERS

New York State Conservative Party leaders yesterday announced the filing of a verified complaint with the New York State Supreme Court, County of Niagara, to protect the constitutionally prescribed voting rights of all New Yorkers.

The complaint filed on Thursday in Niagara County, seeks to overturn an unconstitutional action by the State Legislature S8015-D/A10833 signed into law by Governor Cuomo on August 20th, 2020 and now Chapter 139 of the laws of 2020. This Chapter amends Election Law Section 8-400 in clear violation of Article II, Section 2 of the State Constitution. This section establishes specific circumstances in which a registered voter can obtain an absentee ballot.

The Conservative Party maintains that this Chapter makes a permanent change in the State Constitution and as such requires approval of the electorate by placing such amendment on the November ballot. The Legislature and Governor by adopting said piece of legislation have circumvented that process.

The authority that allowed the Governor to open the process of absentee ballots to all voters in 2020 was limited to the authority granted him through the broad temporary emergency powers adopted by the Legislature in the Spring of 2020. Those powers expire with the pandemic.

The State Constitution belongs to the people of New York as a safeguard against runaway governors and legislatures which we clearly now have. The Constitution spells out the rules for absentee voting in great specificity not to inhibit voting, but to protect the integrity of every vote in this state. Those who wish to make changes in these areas are free to do so through a vote of the electorate, but never through legislative action. They simply don’t have that power.

The State Conservative Party successfully challenged the constitutionality of other attempted changes to New York Election Law by the Governor and Legislature in 2020.

Every registered New Yorker should exercise his or her right to vote in every election, but it is imperative that the voting safeguards put in place by our State Constitution be observed to guarantee maximum ballot security. When rules are changed willy-nilly, public confidence in our election processes wane, and that can be a dangerous thing. This complaint seeks to protect the democratic rights of New Yorkers, and we are hopeful for an affirmative outcome by the Court.

Cuomo Calling on White House for Cover

Embattled Governor Cuomo is running out of friends willing to cover up his sexual harassment and abuse allegations. However, it appears he still has the cover of President Joe Biden.

Reports from in and around the White House are that the President and Vice President are split on how to respond to the scathing allegations surrounding Cuomo. Biden has remained loyal to Cuomo saying an investigation should be carried out, while it is rumored Vice President Harris is ready and prepared to call on the Governor’s resignation.

On Wednesday, the Washington Examiner wrote this story featuring myself and Dutchess County Executive Marc Molinaro.

I am happy that national publications have continued to follow the Governor Cuomo scandal closely and I hope that they also continue to remember that it does not end with the claims of sexual harassment and assault, but with the nursing home death cover up.

It is important that we continue to remember all those lost and the lies that came out of Albany in an effort to diminish the whistleblowers and those calling for the truth.

NY legislature proposes nearly $7 billion in new taxes on wealthy.  See our response here.  For your information, in 1970 New York State had 41 Congressional Districts, when reapportionment takes place next year, we will lose at least one, possibly two seats, bringing us down to 26 (possibly 25) Congressional Districts.  The land mass of New York has not changed; people leaving in droves has reduced our representation in Congress.  (The Assembly, by contrast, has 150 Members, set by the NYS Constitution, and that number has been consistent since the 1938 Constitutional Convention was adopted.)  Spending in NYS is driving taxes up and driving people out.  Perhaps the time to reduce the number of Assembly Members has come.

Despite Infusion of Washington’s Cash; Democrats in NYS Plan Nearly $7 Billion in New Taxes on New Yorkers                                                 Statement by Chairman Gerard Kassar

 Brooklyn, NY — The Democrat controlled New York State Legislature, despite the infusion of fresh federal aid to NY ($12.6 B directly to state coffers) is poised to pass one-house bills that include a massive tax increase on businessmen and the wealthy; a 22.6% increase in spending over last year; 10.5% more than Governor Cuomo’s proposal.

Increasing the taxes on businesses and the wealthy will only further the exodus that has steadily increased over the past 10 years.  New York state cannot afford any additional losses.  This impractical plan will end up costing every New Yorker.  Spending is the problem.  If these Bills are enacted, the Democratic-controlled Legislature is shouting that New York is closed for business and encouraging New Yorkers to move to a state where they have better control over the money they earn.

D.C. Democrats Continue to Push Through Radical Agenda

With all the attention statewide focused on Governor Cuomo, his six sexual harassment claims, and pending federal investigation into nursing home death coverups, it is easy to lose track of all the bad Bills that Congress is passing in  Washington, DC.

This week they passed the $1.9 trillion “COVID-19 relief” Bill that had little to do with relief and more to do with giving money, that we do not have, away to foreign nations and spending on projects that have nothing to do with giving people and businesses the aide they need.

Every member of our delegation, Elise Stefanik, Lee Zeldin, John Katko, Nicole Malliotakis, Tom Reed, Andrew Garbarino, Claudia Tenney and Chris Jacobs all voted NO for the new round of stimulus that will cost each individual American over $5,000 to pay for.

Joe Biden and Nancy Pelosi also continued their assault on the 2nd Amendment with the passage of H.R. 8, the “Bipartisan Background Checks Act of 2021”, and H.R. 1446, the “Enhanced Background Checks Act of 2021”.

While all three bills passed the House this week, we are proud of the members of our delegation who voted NO.

I thank them all for their level-headed, common sense approach to all the legislation they voted on this week. Having had many discussions with the Congress members from NY, I can tell you they were on the right side of these votes from the start.

Cuomo’s Woes Continue

There have been no good days for Governor Cuomo the last few weeks, and it does not appear any are on the horizon.

Cuomo was accused by a 6th woman this week; this time of sexual assault in the private residence of the Governor’s mansion. It has been referred to the local police to begin a probe into the Governor, potentially leading to a criminal investigation. If police choose to find the woman’s claims credible, Cuomo will officially be under investigation by two separate law enforcement entities at both the state and federal level.

On the Albany front, the entire Republican conference, and a growing number of Democrats, including leadership, have called on the Governor to resign. With more than half of the combined State Legislature having moved towards his resignation or impeachment, it is clear he has lost all ability to Govern and lead a legislative body.

When you have lost Albany, you have lost the people. New York needs a functional, working Government. Nearly a year ago, Andrew Cuomo prioritized a book deal, with a seven-figure advancement, over the health of New Yorker’s. While nursing home deaths piled up, and field hospitals remained empty, Cuomo was working on his fictional account of what a great leader he is.

His book is an egregious attack on our intelligence and disgusting show of self-promotion. We knew it then, and thankfully the entire world knows it now.

Brooklyn, NY – “Andrew Cuomo’s tenure as governor could abruptly come to an end, and it’s critically important that Lt. Governor Kathleen Hochul be fully immersed in all state government matters, down to the granular level, in case such an eventuality takes place. Continuity of government in the midst of significant challenges must be ensured. That doesn’t appear to be the case today, based on the Lt. Governor’s public schedule.

“Lt. Governor Hochul should immediately and significantly be included in the state budget negotiations with Senate and Assembly leadership, Covid vaccine rollout planning, federal relief negotiations with the Biden Administration, and other core state operations. Publisher Halts Promotion of Cuomo Book, Citing Nursing Homes Inquiry.  It is positive news that Crown Publishing has halted promoting of Gov. Cuomo’s book, but the question still remains; how much did he profit from it?  According to this article in today’s NY Post, “Embattled Gov. Andrew Cuomo’s book celebrating his response to the COVID-19 pandemic fetched a seven-figure advance – as publishers sought to capitalize on “another political star,” according to a new report.”  But we won’t know for sure until he files his financial disclosure by May 15.  According to the article, the governor has said he would donate a portion of his take to an unspecified coronavirus-related charity. Paul Grondahl writes in the Albany Times Union that Cuomo’s mother, sister remain by his side amid accusations;  “I don’t like what he’s going through,” Matilda Cuomo says.  In all honesty, no Mom would like the allegations her son, Governor Andrew Cuomo, is facing.  The whole article is about the allegations of the 5 (now 6) women who claim to have been sexually harassed by him.  What is missing from Mr. Grondahl;’s column is how Momma Matilda and sister Maria Cuomo Cole have reacted to the growing nursing home scandal and the subsequent cover-up.  Why was that left off the table?  Mr. Grondahl did mention it and the problems that have come to light regarding bolts used in the Mario Cuomo Bridge, yet neglected to let his readers know if they are upset by these allegations also.  Interesting to note, Gov. Cuomo noted in his moving eulogy at Mario’s funeral that Mario told him “You always have to do the right thing.”  The question now is:  Will Andrew Cuomo follow Mario’s sage advice?  The families of those who died in NY’s nursing homes need to know; a grave mistake is one thing – a cover-up of that grave mistake is unforgiveable and most likely criminal.

House Democrats Push Radical Agenda

The Democratic majority has been busy forcing their radical, partisan agenda down the throats of tax paying, law abiding citizens since the beginning of the 117th Congress in January.

This week it was H.R.1/ S.1, better known as “For the Politicians Act.” H.R.1/ S.1 outlaws voter ID, implements same day voter registration, begins public financing of federal elections, and supports the groundwork for Washington D.C. statehood.

At a time when confidence in our election system is at an all-time low, we should not be passing legislation that bans voter ID and allows for same day voter registration giving our election boards no time to vet new registrants properly.

H.R.1/ S.1 isn’t about protecting the rights of voters, it’s about seizing control of our time-tested state election processes to benefit the Democratic Party. This massive federal overreach would politically weaponize the Federal Election Commission (FEC), a traditionally bipartisan commission, and force taxpayers to pay for the re-elections of career politicians. It would further discourage Americans from exercising their First Amendment rights by abolishing privacy laws that protect them from the left’s pernicious cancel culture tactics. Any way you look at this bill it screams Big Brother.

The George Floyd Justice in Policing Act, a reform bill that bans chokeholds and alters the so-called qualified immunity for law enforcement, which would make it easier to pursue claims of police misconduct, was also passed in the House. This bill does nothing but make an already tough job more difficult on law enforcement and allows for the defunding of police and their equipment, such as bulletproof vests.

This last week, Democrats in Congress showed the American people once again their wallets and personal safety mean nothing to them. It is imperative we work to take back the majority in 2022 to stop even more radical legislation from making it to the House floor.

Smoke and Mirrors from Albany Democrats

 Democrats in the State Legislature provided us with more lip service this past week as they pretended to work tirelessly for the people of New York and strip embattled Governor Cuomo of his emergency powers.

The bill passed by the Legislature merely affects new Executive Orders and allows the previous orders to be extended beyond April 30, with the Governor being allowed to amend them if his Department of Health deems its a necessity. The reality is that potential new orders will cover any area imaginable.

With the trust in our Governor and State Department of Health being at an all-time low following the revelation of the nursing home death cover ups, and yesterday’s breaking news that the Cuomo Administration altered documents and withheld data since at least July, Governor Cuomo should not only lose all his emergency powers immediately and into the future, he should resign his seat immediately.

Now is not the time for Democrats to play games in Albany, with all the information we have received the past few weeks, it is clear, Andrew Cuomo is not fit to serve anyone other than Andrew Cuomo.

Governor’s Race

 I was pleased to hear that Congressman Lee Zeldin is exploring a race for Governor. There is no doubt he is a very strong candidate capable of running a good race and representing the state of New York.

He joins Congressman Tom Reed who has also expressed interest, and would be a formidable candidate.

I suspect others will also come forward, but, the bottom line is that the Governorship is in play and with the right candidate, we could be looking at a much needed changing of the guard in Albany.

Recent polling also indicates Senator Chuck Schumer is overstaying his welcome as the Senior Senator from New York. 2022 is shaping up to be a very important year for our state as voters from many political parties have woken up to the reality of what Governor Cuomo is doing to our great state.
