CALL FOR SUBSTANTIAL CHANGES TO A STATE BUDGET PROCESS GONE OFF-KILTER DURING ANDREW CUOMO YEARS

Latham, NY – Jan. 27…Assembly Republican Leader Will Barclay (R,C,I,Ref-Pulaski), State Senator Daphne Jordan (R,C,I,Ref-Halfmoon), and New York State Conservative Party Chairman Gerard Kassar today called for substantial reforms to the New York State budget process which has been significantly perverted under Gov. Andrew Cuomo’s three terms in the Executive Chamber.

The Senator, Assembly Leader, and Chairman called for immediate consideration of two powerful legislative reform measures that would: a. protect taxpayers against ever-escalating tax increases; b. safeguard the traditional budget process, and c. guarantee the proper parsing of legislative items that don’t belong in budget bills. Governor Cuomo has made folding legislative initiatives into budget bills to avoid debate and maximize leverage over state legislators, who must vote up or down on massive budget bills, his signature governing tactic, however inappropriate.

“Once again, Governor Cuomo is misusing the budget process to push through radical legislation that might never see the light of day through regular legislative processes,” Senator Jordan said. “The Executive Chambers’s ‘take-it-or-leave-it’ position smacks of an  authoritarianism that has no place in a constitutional democracy. These bills would restore spending and budgetary sanity to a state in desperate need of both.”

“New York’s budget process has been hijacked to serve as a vehicle for policy initiatives

that rightfully should be debated during regular legislative sessions,” Assembly Minority Leader Will Barclay (R, C – Pulaski)  said. “These initiatives can have a significant impact on the lives of New Yorkers and they must be vetted by the State Legislature, as they were intended to be, one bill at a time.”

“There are three branches of State government — not two — but you wouldn’t know it the way Governor Cuomo has been running roughshod over the State Legislature,” Chairman Kassar said. “His practice of ramming through radical initiatives by attaching them to budget bills is dangerous and Constitutionally inappropriate. New Yorkers have a right to be heard on matters of great importance; it’s why they elect the senators and assembly members who must, now, reassert their authority.”

The bills advocated are:

(A.6018-Barclay): An Act to set parameters for the content of budget bills, ensuring that budget negotiations are focused on financial, not policy issues, and

(A. 3538-Palmesano):  Creating a constitutional amendment requiring 2/3 vote for any bill that raises taxes or creates a new tax.

Senator Jordan announced at the news conference that she will be sponsoring companion bills to these measures in the State Senate in the coming weeks. Senator Jordan has already introduced a bill (S.3373) that would  amend the State Constitution to restrict the ability of the executive to make laws via the budget.

Recent examples of Governor Cuomo improperly ramming through policy initiatives using the state budget process include the introduction of Cashless Bail in New York — a measure he now admits is problematic — granting undocumented immigrants taxpayer-paid college funds; sports betting in casinos, and the creation of a commission seeking to finance state elections with public dollars and eliminate Democratic Party political competition. (The Conservative Party has challenged the constitutionality of the latter in New York State Supreme Court, and is currently awaiting the court’s decision.)

This year, the Governor is seeking, among other things, to legalize paid gestational  surrogacy — an illegal practice in many European countries that was expressly outlawed by Governor Mario M. Cuomo —  and to legalize the recreational use of marijuana. By submitting these and other legislative items in the budget process, the Senator, Assembly Leader, and Conservative Chairman argued, the Governor is attempting an end-around the State Legislature, stifling debate on the measures that common sense demands.

Today’s news conference was held at the 53rd-Annual State Conservative Party “CPPAC” gathering which was held in Latham, NY.

“After 10 years as governor, in his 11th budget address, Governor Andrew Cuomo finally admitted that high tax-and-spend government harms New Yorkers.

“Conservatives could have told him that on day one. So could the more than one million former New Yorkers who have fled the state under his stewardship.

“Now the Governor is facing a $10 billion budget deficit — while the national economy soars — and his nebulous solutions and utter lack of detail in this address show the same leadership deficit that created the giant hole in the first place.

“All we got today was more empty talk. It will be up to a Democrat-led legislature to fill in the blanks. Hold onto your wallets.”

An interesting aside regarding today’s Siena Poll, is that when asked in April about the new Criminal Justice Reform Act that just passed, 55% of the respondents supported the law, while 38% did not.  Quite a turnaround when people realized what it entails.  Today’s poll also indicates overwhelming support for a dozen of Cuomo’s State of the State proposals and a boost to his favorability and job performance ratings.  One can’t help but wonder, as residents learn what these progressive plans cost and how they effect their daily lives, will they still support them and him?  Once people understand the consequences, I doubt Governor Cuomo will ride the wave of true success.

Senate Passes USMCA

President Trump scored his second trade victory in as many days as the U.S.-Mexico-Canada Trade Agreement was passed by the Senate Thursday replacing the North American Free Trade Agreement. The New USMCA passed 89-10. This comes shortly after China and the United States signed phase one of a new trade deal in which China will purchase an additional $200 billion worth of goods from the U.S.

The new trade agreement, known as the USMCA, is expected to generate an increase in U.S. agriculture imports while maintaining the duty-free access for a majority of U.S. goods sent to Mexico and Canada while increasing America’s agricultural exports by an estimated $2.2 billion.

As to be expected, Senator Chuck Schumer, although praising the deals “very good labor provisions,” couldn’t handle giving the President another win without opposition. Although the bill passed with overwhelming bipartisan support, he was one of the 10 nay votes.

The passage of the USMCA provided yet another boost to the market as it surpassed 29,335 Friday. The Trump economy continues to grow and shatter records.

U.S. home building surged to a 13 year high, black and Hispanic unemployment rates remain at record lows, while nationally the unemployment rate continues to hover around a 50 year low.

Americans are winning in the Trump economy.

Bail Reform Fails

It has been 17 days since sweeping bail reform legislation took affect throughout New York, and it is clear the hastily done bill has fallen short and poses a direct danger to residents.

The reformed law completely strips judges of their ability to set cash bail requirements for crimes considered to be non-violent. Though many of the offenders released are dangerous and pose a threat to innocent lives.

One of the beneficiaries of New York State Senate and Assembly Democrats is Anthony Hart. Hart was arrested in November and charged with 4th degree arson, but released soon after due to the pending changes. 4th degree arson is now just one of the dozens of crimes judges no longer have the authority to set bail for. Hart was re-arrested earlier this month and charged with the rape of a 14-year-old girl.

In another tragic story, Maria “Rosie” Osai, was killed by a drunk driver on Christmas Eve in Rockland County. The driver, an illegal immigrant operating the vehicle with no license while under the influence, was “arrested, detained, and released all before her three kids knew she had died on the streets like a dog”, said Osai’s cousin, Sheila Harris.

Unfortunately, this is just a small look at what has transpired since the bill officially took affect January 1.

Senate Republican-Conservatives have called for an immediate repeal of the law, but Democrat on a party line vote, refuse to even consider it.

The Conservative Party is committed to speaking out against this short sided and hastily done bail reform. Please sign our petition to repeal criminal justice reform. We will not stay silent and we will fight for law abiding citizens.

Governor Cuomo is giving New Yorkers lip service on the Criminal Justice problem while unwaveringly standing with progressives.

And it continues:  New York’s utter criminal justice madness.  Bob McManus has an excellent article in today’s New York Post taking Governor Cuomo to task regarding the “get-out-of-jail-free” mess but doesn’t stop with Governor Cuomo.  McManus writes “Certainly, as it is becoming increasingly clear, Albany doesn’t care.”  He then mentions how Speaker Heastie and Senate Leader Stewart-Cousins have no real desire to address the problem.  All the more reason for you and everyone you know sign our petition.  Governor Cuomo and the members of the legislature have to know that people are truly concerned about cashless bail and the outrageous new 15-day discovery mandate.  We must stand together, for rest assured, the progressives that pushed this disgraceful bill are and pushing back.  If, for one minute one thinks this is not the democrat controlled legislature, think again.

Another problem we face in New York State; Man charged in murder of 92-year-old Queens woman in country illegally: Officials.  Why wasn’t ICE there to detain/deport him?  Sanctuary cities – another progressive ideal that puts New Yorkers in harms way.  Advocates call on state lawmakers to outlaw ICE arrests at courthouses.  If a person does not respect the rule of law for entry, why would anyone believe that they will respect any of the laws of the country they entered?

When did the democratic party forget the battle cry of James Carvell: It’s the economy, S****d?  We have to adopt, It’s the spending, Gov. Cuomo, that is driving residents to other states.  New York spends twice as much as Florida to keep things running.

The state is over $6 billion in debt, but that doesn’t concern Governor Cuomo as he announces the NYS flag should be changed.  New York’s flag has been the same for a century. Why Andrew Cuomo wants to change it.  Maybe he is embarrassed that NY’s motto is Excelsior – translation:  ever upward and our population has been ever downward since his election to the executive chamber.

While the Democrats play the Impeachment game, President Donald J. Trump signs a new trade agreement with China.  One thing is certain, President Trump will not hesitate to make China keep their end of the negotiations.

Cuomo dodges bail-reform issues in State of the State address.   The hottest topic in New York State and Gov. Cuomo can’t find the words to talk about it in the State of the State?  The man only hears progressive voices who kiss his ring; those who dare to have a differing view are told they have no place in New York.  Believe me, he will only give the groundswell of people calling for changes in the Criminal Justice Reform bill lip service…until time runs out.  Tell the Governor: Government’s responsibility is to protect her citizens:  Sign our petition here.

Sheriff Cites Recidivism in Release of Accused Under Bail Reform Laws.

Surprisingly, not everyone agrees that the Criminal Justice Reform is a dangerous new law, here is the opinion of an esteemed former judge.  I fail to see her reasoning on the discovery portion of the bill. How is anyone, especially victims and/or witnesses safer when the alleged criminal is given the phone number, including a cell phone number, the exact address of the victim and/or witness within 15 days when they have be released on cashless bail?  If the crime took place in the home of the victim, it has to remain exactly as it was until the alleged perpetrator can examine the premises.  Sign our petition today.  Have your family and friends sign it as well.  Thank you for taking a stand against this insanity.

Cuomo Details Proposal for New Domestic Terrorism Criminal Charge to NY Penal Law.   Unfortunately, the hate crimes that are now on the books are not applied evenly and everyone should be concerned that another law will not change the problem.  The state has to do more to eliminate the “need” for more hate crime legislation and much more to help the mentally unstable people who lash out on innocent people.  There are many parts to the growing problem, adding another law will do absolutely nothing to prevent domestic terrorism other than making politicians feel like they accomplished something.

Ouch.  If the Governor has his way; your property taxes will skyrocket!  Cuomo targets Medicaid spending at local level to close $6B budget deficit.

Statement by New York Conservative Party Chairman Gerard Kassar on Governor Andrew Cuomo’s State of the State Address

“Families are leaving New York in droves because it’s too hard to get ahead here, and everybody knows it. That’s the indisputable state of the State in January 2020 — I dare Governor Cuomo to deny it.

“His perennial window dressing ignores that, for much of New York, there’s nothing left in the store. We’ve been hollowed out by taxes, regulation, bureaucratic mismanagement, and government corruption.

“New York needs to move in a bold new direction, but Governor Cuomo and the Democratic Senate and Assembly are driving us ever deeper into the hole they’ve created. The State faces a $6 billion budget deficit, and the Governor is proposing billions in new spending. That’s not serious leadership.

“We pay the highest taxes in America — we’re watching whole swaths of the population fleeing — and Democrats in the Legislature are again proposing new taxes. Hundreds of thousands of New Yorkers need safe, affordable housing, and the Democrat-led Legislature is making it near impossible for small landlords and developers to improve existing properties or build additional ones. In whose mind is that rational?

“We see the loss of common sense in criminal justice, too, with vicious criminals and anti-Semites being released onto the streets without bail — as violent crime soars in our cities. We shudder at the moral decay of a governor who, against the will of his own father, wants to commercialize child bearing.

“New York is a rudderless ship taking on water under total Democratic leadership. Mark my words: a mutiny of common sense is coming.”

Governor Cuomo’s State of the State continues the out of control spending.
